Terms of Use and Commercial Conditions

1. Acceptance of Terms

By accessing or using Wright Aviation Intelligence ("the Service"), you agree to be bound by these Terms of Use and Commercial Conditions. If you do not agree to all of these terms, you must not use the Service. We reserve the right to update these terms at any time; continued use of the Service after changes are posted constitutes your acceptance of the revised terms.

3. Description of Service

Wright Aviation Intelligence provides aeronautical information services for Colombian airspace, including NOTAM data, aerodrome status, aeronautical charts, RAC regulations, and artificial intelligence tools. All information is sourced from official aeronautical publications and automated data feeds but is provided solely for informational and situational awareness purposes.

4. Not for Operational Flight Planning

The information provided by this Service is NOT certified for operational flight planning or navigation. Pilots, dispatchers, and aviation professionals must verify all aeronautical data against official and current sources, including but not limited to Aeronautica Civil de Colombia (Aerocivil) publications, official NOTAM systems, and applicable AIP supplements.

5. Account Registration

Certain features of the Service require account registration. You agree to provide accurate, complete, and current information during registration and to keep your credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately at snellcssas@gmail.com if you suspect unauthorized access.

6. Plans, Pricing, and Taxes

The Service offers the following plans and products:

• Free Plan: basic access to AIP data with 1 free AI interaction (total, does not renew).
• Pro Monthly Plan: $30,000 COP/month with 30 AI interactions per month.
• Pro Yearly Plan: $299,000 COP/year with 30 AI interactions per month.
• Extra AI Packs: 10 interactions ($9,900 COP), 25 interactions ($19,900 COP), 100 interactions ($69,900 COP).

7. AI Quota Rules

AI interactions are governed by the following rules:

• Monthly reset: the 30 interactions in the Pro Plan reset at the start of each monthly billing cycle. Unused interactions from the previous cycle expire and do not carry over to the next cycle.
• Extra packs: interactions from purchased extra packs do not expire while the account is active. They are consumed only after the monthly plan interactions are exhausted.
• Free Plan: the initial free interaction is a one-time credit that does not renew.
• Paused account: during the pause period, AI interactions are not available and the billing cycle is suspended.

8. Automatic Subscription Renewal

Pro Plan subscriptions (monthly or yearly) automatically renew at the end of each billing period unless the user cancels before the renewal date. The charge will be applied to the registered payment method. Before each renewal, we will send an email reminder at least five (5) days in advance indicating the amount to be charged and the renewal date.

9. Cancellation and Refunds

The cancellation and refund policy is as follows:

• Subscription cancellation: you may cancel your subscription at any time from the My Account section or by emailing snellcssas@gmail.com. Cancellation takes effect at the end of the current billing period. You will retain access to Pro features until the already-paid period ends.
• Subscription refunds: if you request a refund within the first five (5) calendar days of your first charge, we will issue a full refund. After that period, no prorated refunds are issued for partial periods.
• Extra AI Packs: extra AI interaction packs are non-refundable once at least one interaction from the pack has been consumed. If no interactions have been used, you may request a refund within thirty (30) calendar days of purchase.

10. Right of Withdrawal and Payment Reversals

In accordance with Articles 47 and 51 of Law 1480 of 2011:

• Right of withdrawal: the consumer may exercise the right of withdrawal within five (5) business days following the purchase of the service, provided that the included AI interactions have not been used. To exercise this right, send an email to snellcssas@gmail.com stating your request.
• Payment reversal: for electronic payments, the consumer may request payment reversal within five (5) business days following the transaction when: (a) it was the subject of fraud; (b) the transaction was not requested; (c) the purchased service was not received; or (d) the service does not correspond to what was requested. The request must be directed to snellcssas@gmail.com with the transaction information attached.

11. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable aviation regulations.
• Attempt to gain unauthorized access to any part of the Service or its underlying systems.
• Reproduce, distribute, or create derivative works from our data or content without written authorization.
• Use automated scripts or bots to scrape or bulk-download content.
• Interfere with the availability or integrity of the Service.

12. Intellectual Property

All software, design, trademarks, and original content on this Service are the exclusive property of Wright Aviation Intelligence or its licensors. Raw aeronautical data sourced from Aerocivil and ICAO publications remains the property of the respective issuing authority.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of accuracy, completeness, merchantability, or fitness for a particular purpose.

14. Limitation of Liability

To the fullest extent permitted by law, Wright Aviation Intelligence and its operators shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service.

15. Personal Data Protection

The processing of your personal data is governed by our Personal Data Processing Policy, prepared in compliance with Law 1581 of 2012, and by our Privacy Policy.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Colombia. For dispute resolution, the parties submit to the jurisdiction of Colombian courts. The consumer may also contact the Superintendence of Industry and Commerce (SIC) as the consumer protection authority.
